By using this website you accept these terms. If you don't accept them, please don't use the site. We may update these terms from time to time; the version published here at the time you use the site is the version that applies, and material changes are reflected in the “last updated” date at the top.

3. Website content and vehicle listings

We take care to keep this site accurate, but the information on it is provided as a general guide only:

• Vehicle listingsdescribe vehicles that in most cases we are selling on behalf of their owner, not vehicles we own. Specifications, odometer readings, features and history are supplied by the owner and from vehicle reports, and while we pass on what we're told and check what we reasonably can, we cannot independently verify every detail.
• A listing is not an offer. It is an invitation to enquire. A sale is only formed when a written sale agreement is signed. A vehicle may sell, be withdrawn, or have its price changed at any time before then.
• Availability and price can change without notice, and a listing may remain visible briefly after a vehicle is sold or placed under offer.
• Photographs are of the actual vehicle unless clearly marked otherwise. Colours can appear differently between screens.

Always satisfy yourself before you buy. We encourage every buyer to inspect the vehicle in person, arrange an independent pre-purchase inspection, and obtain their own vehicle history and security-interest report. Nothing on this site is a substitute for doing that.

4. Prices, estimates and calculators

Service prices shown on this site (detailing packages, consignment packages, commission rates and fees) are indicative and current at the time of publication. Commission rates in particular vary from vehicle to vehicle, and the rate that applies to you is the one in your signed consignment agreement.

The finance calculator on our listing pages is an illustration only. It is not a quote, an offer of credit, or financial advice. It does not include establishment fees, broker fees, insurance, or any other charge a lender may apply, and the interest rate it uses is one you select rather than one you have been offered. Your actual repayments depend entirely on the lender's assessment and the contract you sign with them.

We are not a lender or a financial adviser. Where we refer you to a finance provider, they assess and contract with you directly, and their terms apply.

5. Our services

Consignment

Under a consignment arrangement we market and sell your vehicle as your agent. You remain the owner until the vehicle sells. The specific terms — package, commission, storage, the agreed asking price and the term of the agreement — are set out in the consignment agreement you sign before we take the vehicle. We do not sell a consigned vehicle below the agreed price without your approval.

Wholesale purchase

Where we buy a vehicle outright, that is a straightforward sale to us, on the terms of the purchase agreement signed at the time.

Vehicle sourcing

Where we source a vehicle for you, we act on the brief you give us. We can't guarantee that a vehicle matching a particular brief will be found, or found within a particular time or budget.

Detailing

Detailing services are performed with reasonable care and skill. Detailing improves a vehicle's presentation; it cannot remove every defect, and outcomes vary with the vehicle's condition. We'll tell you honestly what we expect to achieve on your vehicle before we start.

6. If you're selling through us

You confirm that:

• you own the vehicle, or are authorised by the owner to sell it;
• the vehicle is free of any money owing or security interest, or you have told us in writing about any that exists, so it can be discharged on settlement;
• the information you give us about the vehicle — odometer reading, service and accident history, imports, modifications and known faults — is true and complete to the best of your knowledge.

This matters to you as well as to us. Misrepresenting a vehicle's history or odometer is an offence, and it exposes both of us to a claim from the buyer.

7. Your rights under New Zealand consumer law

Nothing in these terms limits or excludes any right you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Contract and Commercial Law Act 2017, or the Motor Vehicle Sales Act 2003, and any attempt in these terms to do so has no effect.

Where you acquire our services for the purposes of a business, and it is fair and reasonable to do so, you and we agree under section 43 of the Consumer Guarantees Act that the Act does not apply.

If you buy a used vehicle from a registered motor vehicle trader in New Zealand, you can take a dispute about that vehicle to the Motor Vehicle Disputes Tribunal. That right applies regardless of anything in these terms.

8. Liability

Subject to section 7 above — which takes priority over everything in this section — we are not liable for indirect or consequential loss, or for loss of profit or opportunity, arising from your use of this website or from our services. Where we are liable, and to the extent the law allows us to limit it, our total liability for any claim relating to a service is limited to the fees you paid us for that service.

We don't warrant that this website will be uninterrupted or error-free, and we aren't responsible for the content of third-party websites we link to, such as finance providers, listing platforms or inspection partners.

9. Accounts

If you create an account, keep your password confidential and tell us promptly if you think someone else has access to it. You're responsible for activity under your account. We may suspend or close an account that is being used to abuse the site or other users, and you can ask us to close your account at any time.

10. Acceptable use

Please don't:

• submit false enquiries, or use our forms to send spam or unsolicited marketing;
• scrape, harvest or bulk-copy listings, photographs or contact details from this site;
• attempt to gain unauthorised access to any part of the site or its systems;
• use the site in a way that breaks New Zealand law.

11. Intellectual property

The layout, design, text, logo and original photography on this site belong to us or our licensors. You may view, download and print pages for your own use, or share a link to them. You may not republish our photographs or copy substantial parts of the site for commercial purposes without our written permission.

Vehicle photographs are taken by us or supplied with permission. Brand names and logos shown on this site are the trade marks of their respective owners and are used to identify vehicles and partners, not to suggest those brands endorse us.

If you believe something on this site infringes your copyright, email info@mvconsignment.nzwith the details and we will review it and remove anything we shouldn't be using.

12. Privacy and cookies

How we handle personal information is set out in our Privacy Policy, and how this site uses cookies is set out in our Cookie Policy. Both form part of these terms.

13. Cancellations and refunds

14. Governing law

These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction over any dispute about them.
